Individual Malpractice Defense Policy
Legal Defense Expense Insurance Benefits and Coverage
FHPLEI’s medical malpractice legal expense insurance policy is a CLAIMS-MADE POLICY AND DOES NOT PROVIDE INDEMNIFICATION FOR ANY FINES, AWARDS, JUDGMENTS, OR OTHER MONETARY PENALTIES. FHPLEI offers its policyholders four annual policy limit levels: $25,000; $50,000; $75,000 and $100,000. You decide what level is most appropriate for your comfort level, previous and/or anticipated claims history, specialty and financial situation. We also offer interest-free premium financing to help you better manage the cash flow of your practice.Policy Benefits
The policyholder will receive the following policy benefits provided all other terms, conditions, and eligibility requirements are met:- Payment of reasonable and customary attorney’s fees and expenses for legal services rendered on your behalf up to the policy limits.
- Payment of reasonable costs, including, but not limited to, expert witness fees and/or medical record audit fees, utilized in the policyholder’s defense up to the policy limits.

Claims Covered Under the Terms of the Policy
- FHPLEI will provide legal expense insurance benefits in the event the policyholder is notified of legal action for damages due to personal injury, disablement, or wrongful death arising out of an act, error, or omission in providing professional medical services.
- FHPLEI’s medmal policy also provides an additional $10,000 of coverage for legal expense insurance benefits for professional licensing investigations, civil Medicare and Medicaid fraud investigations, civil HIPAA investigations, and OSHA complaints.
Group Practice Malpractice Defense Policy
Physicians are not the only defendants named in malpractice claims. Therefore, FHPLEI offers a policy to include the practice as a legal entity itself and provides coverage to its certified and licensed staff. Physicians purchase annual policy limits for $25,000; $50,000; $75,000 or $100,000 each. The practice then adds its own policy up to $100,000 in coverage. Together the policies are “pooled” into one financial resource that is available for the entire practice. You decide what level is most appropriate for your previous and/or anticipated claims history, specialty and financial situation. We also offer retroactive coverage as well as interest-free premium financing to help you better manage the cash flow of your practice.
Just like the individual malpractice policies, the corporate entity and its covered physicians are entitled to the $10,000 Broad-Form defense benefit. However, this coverage is for the physicians and the legal entity individually and is not subject to aggregate benefits.
